ABSTRACT
This article asserts that Iraq and Kuwait have moved off the battlefield and into the courtroom. Chris Gooding, a partner at London firm Howard Kennedy says that one of the things they never teach people at law school is bow to explain to a 10-year-old boy why there is a man in overalls standing in the bushes measuring angles of fire. Iraqi Airways Co. (IAC) first brought its claim against Kuwait Airways Corp. (KAC) in January 1991 following the seizure of 10 aircraft belonging to KAC from Kuwait International Airport. Gooding comments that there is a tendency when the English courts are faced with a sovereign power to show the world that British justice is fair and equal.
