Wendy Medura Krincek, an employment lawyer with Littler Mendelson, states that requiring salaried or exempt workers to take random days off without any sort of pay could result to an increase in potential overtime claims. Labor attorney Kerry Notestine notes that giving managers the sole authority to select who will undergo involuntary leave is not advisable.
