ABSTRACT
The authors comment on visitorial powers denied to New York attorney general Andrew Cuomo in the Supreme Court case Cuomo v. Clearing House Association LLC. The decision maintained that only the U.S. Office of the Comptroller of the Currency has visitorial power over national banks. The authors feel the decision leaves important defenses, including the fact that federal banking law preempts state law, negating an attorney general's action to enforce a preempted law's terms.
