ABSTRACT
In the article the author reflects on the consequences of the approval from the U.S. House of Representatives Financial Services Committee of the financial reform legislation Bair-Miller-Moore provision. He notes that under the provision secured lenders would be able to remove assets from insolvent institutions before the U.S. Federal Deposit Insurance Corporation (FDIC) could take control of the assets.
