ABSTRACT
An essay on the permissive state and access to justice in Brazil is presented. It offers a history of violence against women in Brazil and an analysis of the domestic violence law such as the Law of Protection and Punishment of Violence or the Maria da Penha Law, the inherent challenges and implementation obstacles and the difficulties for incorporating the law in the national legal framework. The author suggests that non-criminal alternatives should be extended for encompassing the complex situations of violence being faced by women.
