ABSTRACT
The article describes the ways that franchisors and their counsel can plan for franchisee financial distress. The best practices for the documentation of franchise agreements are discussed. The strategies for responding to a franchisee insolvency or bankruptcy case are offered. The effects of bankruptcy on a franchise agreement are also outlined.
