The principle of contractual freedom is reflected in the negotiation, conclusion, performance and termination of contracts in private legal relations as an essential principle and family legal relationships can be analyzed in relation to a number of institutions such as matrimonial convention, convention for the choice of the applicable law for the matrimonial regime or the dissolution through divorce or divorce by agreement between the spouses. In connection with the application of the general principle of civil law lato sensu, can be highlighted a number of limitations, subject of this study.
