ABSTRACT
The main idea of this paper is to place the controversy Schmitt x Kelsen on the guardian of the Constitution in the current debate about the functions of constitutional jurisdiction. In this sense, the purpose is to analyze the judgment of the "Clean Record Law" (which deals with eligibility requirements) by the Supreme Court, given its policy relevance. The methodology is simple. The first part contains the theoretical premises of Hans Kelsen and Carl Schmitt, particularly the description of the ideas of each author on who should be the guardian of the Constitution. The second part discusses the case of "Clean Record Law" in the light of this theoretical controversy. At the end, this article suggests a connection between Schmitt's decisionism and the prevalent argument in the Supreme Court.
