ABSTRACT
The article provides an overview of statutes related to employee participation in management in the U.S. The article also discusses application of the employee participation law as applied to the facts in Electromation Inc. and E. I. du Pont de Nemours & Co. decisions and most importantly for employers, factors to consider in establishing any type of employee participation program. A brief update of the current developments in response to the two decisions will enable employers to keep an eye on the developments already at work. The first time the U.S. Supreme Court was faced with interpreting the provisions of the National Labor Relations Act in Pennsylvania Greyhound Lines, it was faced with the type of employee representation plan that the drafters had envisioned.
