ABSTRACT
The article discusses first-degree murders and death penalty eligibility in Colorado as of November 2013, focusing on an empirical study of murder convictions in the state between January 1, 1999 and December 31, 2010. The Eighth Amendment to the U.S. Constitution is addressed, along with Colorado's death penalty statute, aggravating factor liability, and the U.S. Supreme Court (USSC). The USSC cases Furman v. Georgia and McGautha v. California are examined.
