ABSTRACT
The protection of the right to freedom from torture, given the many manifestations of the violation of this right in many countries, is always a current topic and dealing with it serves as a contribution to the efforts aimed at combating the abuse as socially dangerous and harmful phenomenon. Various forms of ill-treatment, as a breach of the right to freedom from torture, constitute a serious attack upon human dignity and the physical and psychological integrity of a person. This paper seeks to analyse a normative framework that involves notions (definitions) of torture and other forms of ill treatment (cruel, inhuman, and degrading treatment or punishment) contained in the International Covenant on Civil and Political Rights, United Nations Convention Against Torture and Other Cruel, Inhuman or Degrading Treatments or Punishments and European Convention for the Protection of Human Rights and Fundamental Freedoms and its application within the jurisprudence of the parties to the international treaties, which generally provide the most efficient protection of the right to freedom from ill-treatment in international human rights law. By applying a normative, dogmatic and comparative-law method, the paper finds that the definition of torture under the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, and the concept of 'minimum cruelty threshold', developed through the practices of the treaty bodies to the international human rights instruments, are essential features of the notions of torture and other forms of ill-treatment in international human rights law.
