ABSTRACT
The article discusses the court case Simmonds versus (v.) Milford Club wherein Simmonds, a club steward for the respondent, was given a final written warning (FWW) on his record. The employment tribunal decided that the dismissal was fair but the British Empoyment Appeal tribunal (EAT) reversed the decision. The EAT ruled that Milford Club failed to show that it was within the band of reasonable responses for its dismissal to be fair.
