ABSTRACT
The article discusses the court case Laclede Gas co. vs. St. Charles County. The Eighth Circuit rejected the argument opposing the agreement between the U.S. Supreme Court and the Missouri Supreme Court that a utility does not need to pay to relocate its equipment if its right to build and preserve that equipment is preceded upon an easement. It further concluded that the plaintiff was likely to win on the merits of its case.
