ABSTRACT
The article discusses the use of criminal mediation in Idaho courts as of May 2013, focusing on several mediation-related Idaho Supreme Court rules such as Rule 18.1 of the state's Rules of Criminal Procedure and Rule 12.1 of the Idaho Juvenile Rules. Criminal mediations are addressed in relation to various stages of litigation such as pre-arraignment, pre-sentencing, and post-trial. Retributive justice and plea bargaining are mentioned, along with mediators and the Uniform Mediation Act.
