ABSTRACT
The article discusses a court case wherein claimant Algerian national Mustafa Moussaoui was detained by the defendant, the British Secretary of State for the Home Department from May 17-29, 2010 under the Immigration Act of 1971 and sought judicial review of his detention in October 2010. The judge considered whether the detention as a mentally disordered detainee was unlawful. The judge ruled defendant's failure to follow the Enforcement Instructions and Guidance (EIG).
