ABSTRACT
The article presents a court case in which the U.S. District Court of Nevada ruled in favor of the U.S. government concerning the use of the Yucca Mountain as a high level nuclear waste repository. In the case Western Shoshone National Council v. the U.S., the Shoshone Indian Tribe filed a case to stop the use of Yucca Mountain as a nuclear waste disposal site, claiming that such action violates the 1863 Treaty of Ruby Valley.
