ABSTRACT
The article focuses on the New York City Health Code Regulation 81.50 requiring all food establishments in the city to display the caloric contents of each menu item to stem the prevalence of obesity and diabetes. It explains how the law led to the calorie-disclosure movement in the U.S. and the passage of the federal Patient Protection and Affordable Care Act (PPACA). It discusses the constitutional perils of passing such laws and why some NYC measures should not be pursued as federal mandates.
