ABSTRACT
The article discusses the role of the Prevention of Significant Deterioration (PSD) and Title V Greenhouse Gas Tailoring Rule in regulation of the bioenergy industry in the U.S. The U.S. Environmental Protection Agency (EPA) promulgated the rule without recognizing that the combustion of biogenic material is carbon neutral for purposes of major-source preconstruction review and permitting under the Clean Air Act. EPA granted a Petition for Reconsideration of the Tailoring Rule in January 2011.
