ABSTRACT
The article discusses the court case R. v. Smith in which the appellants, who were convicted of robbery, argued against the change of their case from stealing to cash to drugs. An overview of provisions of Theft Act 1968 cited by appellants in their argument is given. A trial judge and the Court of Appeal rejected the argument that a person cannot be convicted of stealing an item that is considered illegal for anyone to possess.
