ABSTRACT
The article discusses two Office of General Counsel (OGC) Opinions related to deviations from policy forms issued by the Department of Insurance in New York. It details the arguments of the department which were expressed in OGC Opinion No. 11-01-08 and OGC Opinion No. 10-12-01. The author concludes that agents, insurers, and brokers cannot deviate from approved policy forms by issuing certificates of insurance that change the policy terms in the context of homeowners insurance.
