ABSTRACT
The article traces the history of intellectual property (IP) doctrine, and examines current approaches to misuse doctrine. One approach is that patent misuse, if not copyright misuse, should be defined by antitrust principles, while another approach sees misuse as an attempt to expand IP rights beyond the scope of their statutory boundaries. Several U.S. Supreme Court cases where this doctrine apply are cited.
