ABSTRACT
The work, starting from the analysis of the right of foreigners to a fair trial in Article 24.1 of the Spanish Constitution of 1978, studies the evolution of the doctrine of the Spanish Constitutional Court, remarking some of the most relevant cases and its reflection in the Spanish legislation (Cautio judicatum solvi, arrest, legal aid or constraints for non Spanish people to private prosecution in criminal proceedings, among others). It also discusses some aspects of the role of jurisdiction as a means of controlling public authorities’ decisions that restrict fundamental rights related to foreigners, and their reflection in the recent reform of the Aliens Act of 2000, under the Organic Law 2 / 2009.
