ABSTRACT
The article presents a court case wherein California Trout, the petitioners, filed a late motion to intervene in the Pyramid Dam proceeding held by the U.S. Federal Energy Regulatory Commission (FERC). The CalTrout filed a motion to intervene since the dam's operations will harm the already endangered arroyo southwestern toad. Although the court favored FERC, the decision limits concerned organizations to effectively participate in FERC proceedings and pursue their environmental interests.
