ABSTRACT
The article discusses a court case wherein the Fourth Circuit had struck down a rule issued by the U.S. Federal Energy Regulatory Commission (FERC) in interpreting section 1221 of the Energy Policy Act of 2005 (EPAct). FERC has been authorized to approve the proposed siting of transmission projects in congested areas, known as National Interest Electric Transmission Corridors (NIETC). The congress has taken steps to further expand federal authority over transmission siting of the project.
