ABSTRACT
The article discusses the court case United States v. McCane wherein the U.S. Court of Appeals for the Tenth Circuit ruled that the dictum in District of Columbia v. Heller, which asserted the individual right to bear arms, annulled the constitutional basis of the felon dispossession law. An analysis of the McCane ruling is offered. The lawful regulation of gun ownership and use should reportedly be reevaluated.
