ABSTRACT
Reports that the U.S. Supreme Court (SC) held that in the case Franks v. Delaware, a defendant in a criminal case has a right under the 4th and 14th amendments to challenge the truthfulness of factual challenge in an affidavit supporting a search warrant. Move of the SC of reversing and remanding in an opinion by Justice Blacksmith; Limitations placed by the SC opinion on challenges to the validity of affidavits.
