ABSTRACT
The article focuses on the decision that will be made by the Nevada Supreme Court on an appeal of the smoking ban and the proposed changes by the Legislature to Nevada Clean Indoor Air Act. The constitutionality of the act is being challenged by a group of tavern owners and slot-route operators. According to plaintiff's attorney Bradley Scott Schrager, the act violates the Equal Protection Clause since it allows both smoking and food service in businesses that are considered casinos because of unrestricted gaming licenses.
