ABSTRACT
The article announces that the Nevada Supreme Court has set the date for the hearing of arguments for an appeal to repeal the smoking ban under the Nevada Clean Indoor Air Act on April 6, 2009. Several plaintiffs including the Nevada Tavern Owners Association and slot route operators claimed that the ban violates the Equal Protection Clause and has caused a 50% decrease in business. The state Supreme Court, on the other hand, has set its goal to have the entire act upheld, retaining civil and criminal penalties for smoking ban violations.
