ABSTRACT
The article offers an analysis on the alleged suspension of the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule during a public health emergency in the U.S. It states that the privacy rule was not suspended. However, it mentions that the Department of Health and Human Services may have waived some of the aspects of the rule which is consistent to the Project Bioshield Act of 2004. An overview of the provisions in the rule that may be waived is provided.
