ABSTRACT
The article reports on the defeat of jeweler Tiffany in a legal battle with online auction site eBay. The case covered the sale of counterfeit jewelry on eBay's site. According to Judge Richard J. Sullivan from the U.S. District Court of New York, eBay could not be held liable for trademark infringement based solely on their generalized knowledge that trademark infringement might be occurring on their Web sites.
