ABSTRACT
The article focuses on the proposed Patent Reform Act of 2007 in the U.S. The measure was introduced in April in both houses during the release of findings from reports suggesting that modernization of the patent system was needed to maintain competitive edge in the global economy. The bill sets forth new guidelines for calculating damages in patent infringement cases and the creation of a postgrant review procedure that would expand the ability of third parties to challenge the validity of patents outside the context of traditional patent litigation.
