ABSTRACT
The article reports on the privacy questions raised over texting in the workplace after a ruling was issued by the 9th U.S. Circuit Court of Appeals. The court overseeing cases in Nevada reviewed the case of a public employer, the Ontario, California Police Department and its telecom service provider Arch Wireless. A department employee sued the company claiming that his employer violated his constitutional right to privacy under the Fourth Amendment by viewing his text messages.
