ABSTRACT
The article reports that the constructive eviction, an area of law, has been addressed in the lawsuit between the CCR/AG, the Showcase mall owner, and its tenant United Artists (UA) Theatre Circuit Inc. Attorney Andy Gabriel with McDonald Carano Wilson states that the claim of UA of constructive eviction will be decided based on past case law as it will not be clear-cut and that Nevada has no statute addressing the claim. In constructive eviction, he adds that the landlord should materially interfere with the business.
