ABSTRACT
The article reports on the plan of BASF A.G. to appeal a federal appellate court ruling that bars it from tapping its advertising injury coverage to pay damages it faced after one of its pharmaceutical units misled consumers and health insurers while marketing its thyroid medication. A three-judge panel of the 7th U.S. Circuit Court of Appeals overturned a lower court's decision and ruled that since there was never any potential coverage for the company, the chemical manufacturer's umbrella insurers did not have a duty to defend the company.
