ABSTRACT
The article examines the provisions of the Constitutional Treaty to assess if they are sufficient to invite democratic participation to a level beyond the institutionalized representation system that currently weakens the legitimacy of the European Union (EU). Based on the analysis of Part 1, Title VI, Article 1-46 and 47 of the Constitutional Treaty, this paper concludes that contemporary understandings of democracy demand the redefinition of the body politic to encompass all those who reside in the EU.
