ABSTRACT
The article focuses on the applications of the Insurance Fair Conduct Act (IFCA) in Washington. IFCA allows uncapped treble damages, which is three times the actual damages that normally be awarded to the aggrieved party. It also mandates that insurers are responsible for the costs of expert witness fees and attorneys' fees obtained in establishing the claim. However, it cites that IFCA's provision for penalties is not necessarily straightforward.
