Avrupa Konseyi'ndeki Gelişmeler Işığında 5233 Sayılı Terör ve Terörle Mücadeleden Doğan Zararlarşn Karşılanması Hakkında Kanun

Türkiye Büyük Millet Meclisi 14 Temmuz 2004 tarihinde 'Terör ve Terörle Mücadeleden Doğan Zararların Karşılanması Hakkında Kanun'u (Tazminat Kanunu) kabul etmiş ve bu Kanun 27 Temmuz 2004'te yürürlüğe girmiştir. Tazminat Kanunu'nun uygulanmasına ilişkin olarak çıkartılan 'Terör ve Terörle Mücadeleden Doğan Zararların Karşılanması Hakkında Yönetmelik' ise 20.10.2004 tarihinde yürürlüğe girmiştir. Kanun, terör eylemlerinden veya terörle mücadele kapsamında yürütülen faaliyetler nedeniyle zarar gören kişilerin maddi zararlarının karşılanması yönünde ilke ve prosedürler öngörmektedir. Kanun aynı zamanda terör eylemlerinden veya terörle mücadele kapsamında yürütülen faaliyetler nedeniyle zarar gören kamu görevlilerinin maddi zararlarını karşılamaya yönelik hükümler de içermektedir. Bu amaçla il merkezlerinde ilgili valilikler bünyesinde zarar tespit komisyonları kurulmuştur. Zarar tespit komisyonları, vali onayı ile kurulmakta ve bir başkan ve altı üyeden oluşmaktadır. Zarar tespit komisyonlarının temel görevi, başvuru konusu zararın Tazminat Kanunu kapsamında karşılanıp karşılanmayacağını tespit etmek, zararın ifa tarzını ve varsa mahsup miktarını belirleyerek sulhname tasarısı hazırlamaktır.
