ABSTRACT
The article focuses on the company voluntary arrangement (CVA) case Prudential Assurance Co. Ltd. versus PRG Powerhouse Ltd. It notes that the British High Court has struck down the guarantees released through CVA. The High Court has agreed that a CVA could be used to prevent claims under parent company guarantees in right circumstances. Powerhouse has argued that CVA can be used to alter fundamental aspects of the landlord and tenant relationship.
