ABSTRACT
The author expresses his opinion on the case of a Florida police chief who was dismissed for implementing wellness programs in an attempt to manage group health insurance costs. The Employee Retirement Income Security Act (ERISA) prohibits any discrimination with respect to premiums or benefits in an ERISA plan based on health factors. The chief may have violated the Act if he admitted taking action to limit staff eligibility in a group health plan based on a health factor.
