This article deals with the new state aid framework for research and development (R&D) and innovation adopted by the European Commission. The guidelines allow individual member states to tailor aid measures to particular situations, subject to three key tests including: the aid must address a well-defined market failure. In adopting the new framework, the commission acknowledges that state aid for R&D and innovation can have negative effects on competition, as well as benefits.
