ABSTRACT
The article focuses on issues concerning the underutilization of the 144A private rules by the bank UBS AG. It is informed that the bank did not use 144A private placement rules as part of a "scheme to evade" registering $2.2 billion of Health-South bonds. Bonds worth $2.2 billion were sold by HealthSouth in four publicly registered deals between 2000 and 2002, but UBS did not underwrite those deals.
