Coming to a Theater Near You: The Brave New World of Fiduciary Advisers

The article discusses the Pension Protection Act of 2006, which includes a controversial provision that creates "fiduciary advisers" who can offer personalized advice to pension plan participants or beneficiaries notwithstanding clear conflicts of interest if funds are proprietary. The provision will allow companies to remove liability in defined-contribution plans by providing works access to investment advice, including computerized advice that will qualify as long as it applies generally accepted investment theories and has no bias.
