The article focuses on the insurance policy of D&O Inc. negotiating the terms of the application and related policy provisions in the U.S. First, D&O policies define "Application" to include the eight-page form, and all documents submitted with it and certain public filings. However, the second policy provision that relates to the application is the severability of application clause in which its purpose is to limit the adverse effect of any misstatements in the application.
