ABSTRACT
The article reports that lawyer Diane Sullivan has scored a major victory for Merck & Co. Inc. in the ongoing dispute over rheumatoid arthritis drug Vioxx. On November 3, 2005, a New Jersey jury rejected the claims of an Idaho man who claimed that Vioxx was responsible for a heart attack he suffered in 2001. The New Jersey case is the second piece of Vioxx litigation to reach a judgement, following the August 2005 decision of a Texas jury to award $253m in damages against Merck. The jury found Vioxx to be responsible for causing cardiovascular damage, and ultimately death, to a patient.
