This article reports about the efforts of the political organization Cherokee Nation of Oklahoma of Cherokee, Oklahoma to protect trade secrets by using "open source" computer code for the development of software. The proposal was set forward by Jeff Merkey, a tribal member. Merkey plans to give the tribe an open source computer operating system, which is still under operation. The Cherokee Nation Uniform Trade Secrets Act would protect trade secrets, including programs and allow tribal courts to issue injunctions or award damages for trade secret infringement.
