ABSTRACT
The article takes a look at the debate surrounding dangerous offenders from the Howard League for Penal Reform's perspective. The three elements of criminal seriousness, personal traits and degree of prospective future harm are common sentencing considerations, developed in the Criminal Justice Act 1991. This statute stated that sentences must be commensurate with the degree of culpability and harm caused, but that violent or sexual offenders might be given longer than commensurate sentences in order to protect the public from serious harm, physical or psychological.
