The article reports that in response to an era of heightened scrutiny, San Jose, California, has begun to hire disclosure counsel, in addition to bond counsel, to guarantee that the city is following proper procedure, but ultimately issuers must take full ownership of the disclosure document. Citing a rash of lawsuits over the past decade highlighting improper disclosure procedures, Eric D. Tashman, a partner at Sidley Austin Brown, & Wood LLP stressed that it was imperative that city government officials appreciate their legal responsibilities and understand the municipality's entire financial context.
