ABSTRACT
Similarly to weakening of the rule and law and the judicial system reform in Poland, in relation to which the Court of Justice of the European Union („CJEU”) has already rendered several seminal decisions, yet other cases are pending, the Romanian courts have also referred to CJEU on the interpretation of the European Union law in the context of legislative amendments or Constitutional Court decisions. It is expected that the first decisions of the CJEU will be delivered during winter of 2020 at the earliest, and they are liable to lead to review vertically some legislative choices, in line with the requirements set by the European Commission, under the Cooperation and Verification Mechanism, not only in matters where the European Court was referred to, but also on other issues, for example, the meritbased appointments of judges and prosecutors, especially at the High Court of Cassation and Justice.
